Terms of Service
These terms are an agreement between you and Scaleset LLC ("we", "us"), which operates Parcel Chart: the website www.parcelchart.com and its county pages, the app at app.parcelchart.com, the iPhone and Mac apps, and the Parcel Chart API and connector for AI assistants (together, "the Service"). By using the Service you agree to these terms and to our Privacy Policy. If you use it for an organization, you agree for that organization.
1. Accounts
- You must be at least 16, and old enough to agree to these terms where you live.
- Give a real email address and keep your password and any sessions, devices and assistant connections secure. You are responsible for what happens under your account, including what an assistant you connect does with it.
- One person per account. Share places through invitations instead of sharing a sign-in.
- You can delete your account at any time in Account → Your data. We may suspend or close an account that breaks these terms, and will tell you why unless the law or safety prevents it.
2. Plans
The public map can be used without an account, within a daily allowance. Free accounts and paid plans have the limits shown in the app when you sign up, which we may change with notice. Paid plans, their prices, billing, cancellation and refunds will be described next to checkout before you pay. [Refund and cancellation policy to add with billing.]
3. Your content
Your places, maps, photos, documents and records ("your content") remain yours. You give us permission to host, copy, process and display your content only to run the Service for you and the people you share it with — including sending it to the providers and AI features described in the Privacy Policy — and to keep backups. This permission ends when you delete the content or your account, except for backups and logs until they expire.
You are responsible for your content and for having the right to upload it. If you record information about other people, such as a contractor's contact details, keep it to what you need and follow the law that applies to you. Content you add to a place someone else owns belongs to that place; it stays there if you leave or delete your account.
4. Acceptable use
You agree not to:
- Scrape, crawl or bulk-download data from the Service — through the map, the county pages, the API, the AI connector (MCP) or an AI assistant — or use automated means to go around the daily allowances, rate limits or plan limits.
- Resell, republish or build a competing dataset or product from data obtained through the Service, beyond your own places and content.
- Share or publish your API, connector or session credentials, or use someone else's.
- Use the Service to stalk, harass or target people, or to look up property owners for unlawful purposes.
- Break the law, infringe others' rights, upload malware, probe or attack the Service, or access accounts, places or data that are not shared with you.
- Interfere with the Service or put an unreasonable load on it.
5. Public data and accuracy
Parcel boundaries, ownership and assessment facts, zoning, flood zones, soils, wetlands, elevation, building footprints, imagery and other map layers come from government agencies and public datasets. They can be out of date, incomplete or wrong, and each layer shows its source and date where we have them.
- Parcel lines are not a survey and do not establish boundaries, easements or ownership. Hire a licensed surveyor for that.
- Flood zone layers are not a flood determination for insurance or lending, and may lag FEMA's current maps. Soil and wetland layers are not a site evaluation.
- Measurements, floor plans, 3D models and outlines drawn or estimated in the app are approximate unless you measured them.
- Nothing in the Service is legal, engineering, surveying, financial, tax, insurance or real estate advice. Check with the relevant authority or a professional before you rely on it for a decision.
Third-party data stays subject to its source's terms; attributions are shown on the map and the county pages.
6. AI features
AI features read your documents and photos and suggest records, and the assistant answers questions about your places. AI output can be wrong or incomplete. Suggestions change your records only when you confirm them, and you are responsible for checking what you accept. When you connect your own assistant, its provider's terms apply to that assistant.
7. Our service
We are building Parcel Chart actively and may add, change or remove features. We will try to give notice of changes that take away something you rely on. The Service, its software, design and compiled datasets belong to us and our licensors; these terms do not give you rights in them beyond using the Service. If you send feedback, we may use it without obligation to you.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise the Service will be uninterrupted or error-free. Keep your own copies of important documents; you can export your data at any time.
9. Limitation of liability
To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Service or these terms, and our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim and US$100. Some places do not allow these limits, so they may not all apply to you.
10. Indemnity
If someone brings a claim against us because of your content or your breach of these terms, you will cover our reasonable costs of that claim, to the extent the law allows.
11. Ending
You may stop using the Service and delete your account at any time. We may end these terms or your access if you materially break them, or if we stop offering the Service, in which case we will give you reasonable notice and a chance to export your data. Sections 3 (for backups), 5, 8, 9, 10 and 12 survive.
12. Law and disputes
These terms are governed by the laws of [state], without regard to its conflict-of-laws rules, and disputes go to the courts of [county, state], unless the law where you live gives you the right to bring them elsewhere. [Counsel: arbitration or not.]
13. Changes to these terms
We will post changes here with a new date, and tell account holders of significant changes by email or in the app before they take effect. Using the Service after that means you accept them.
